Supreme Court dismisses the constitutional challenges to the anti-LGBT bill

Two suits argued the Human Sexual Rights and Family Values Bill was unconstitutional. The court rejected both, unanimously.

18 December 2024

Ghana's Supreme Court unanimously dismissed two suits, brought by Richard Sky and by Dr Amanda Odoi, that challenged the constitutionality of the Human Sexual Rights and Family Values Bill. Reuters and the BBC reported the rulings on 18 December 2024.

The court did not rule on whether criminalising a person's identity is compatible with the constitution's guarantees of dignity, privacy, expression and association. It disposed of the cases on procedural grounds, leaving the substantive questions unanswered.

For queer Ghanaians, the practical effect was immediate: the last visible legal obstacle to the bill fell away, and with it much of the argument that the courts would act as a brake.
